Sheikh Mohammed issues decrees

ABU DHABI: The Vice President, Prime Minister and Ruler of Dubai, His Highness Sheikh Mohammed Bin Rashid Al Maktoum, has issued the Cabinet Decree No. 03 of 2018 on the adoption of a National Classification of People of Determination.

The Decree, published in the latest issue of the Official Gazette, stipulates that the UAE Cabinet shall make any amendments to the classification based on the proposal of the Minister of Community Development.

The Decree defined its fundamental principles in the need for a unified classification of impairments, disabilities and handicaps at the state level.Further, it serves as a national reference to be used by all parties in accordance with its services for persons with disabilities. It also help increase the level of coordination and cooperation between the concerned authorities to standardise the tools for identifying the needs for persons with disabilities.

According to the classification, impairments, disabilities and handicaps include mental disability, communication disorders, autism spectrum disorder, attention deficit disorder, hyperactivity, specific learning difficulties. It also includes visual impairment, hearing impairment, visual and hearing impairment, physical disabilities, and psychosocial disorders.

Human Resources Law

Sheikh Mohammed has also issued Ministerial Decree No. 01 of 2018 on the Executive Regulations of Federal Decree Law No. 11 of 2008 on Human Resources in the Federal Government and Amendments thereof.

The Executive Regulations include 14 chapters in which 135 articles detail on how to deal with organisational structure, evaluation and description of jobs, allowances, grades, salaries, transport, assignment and secondments. It also details on performance, remuneration, promotions, training, development, official and training tasks, leave types, job violations, grievances, institutional culture, termination of service and signing of contracts.

Financial Policy

Sheikh Mohammed further issued the Cabinet Decree No. 60 of 2017 amending Cabinet Resolution No. 24 of 2015 on the Government Financial Policy Coordination Council.

The Decree published in the Official Gazette stipulates that it shall replaces Article No. 09 of the 2015 Cabinet’s Resolution on the Government Financial Policy Coordination Council, as follows, The Council shall submit an annual report on its work and achievements to the Minister of Finance. The submission shall also including the suggestions and recommendations necessary for the fulfilment of its functions, in accordance with the procedures set out in the manual of the committee’s working systems in the Federal Government as approved by the UAE Cabinet.

The Decree shall be effective from the date of its issuance in the Official Gazette.

Digital certification

Sheikh Mohammed furthermore issued a Cabinet Decree No. 62 of 2017 concerning developing fees for Electronic Connectivity Project and Digital Certification Portal services provided by the Federal Authority for Identity and Citizenship.

The Decree sets a fee of Dhs5 per transaction for each of the services for less than 500,000 transactions, Dhs4 for transactions ranging between 500,000 to one million and Dhs3 for transactions between 1 million and 1.5 million.There will also be a charge of Dhs2 per transaction for those that exceed 1.5 million. Federal and local government agencies are exempted from paying the above fees.

In Article No. 03, the Decree stipulates that a subscription fee of Dhs25,000 is set for access to the Electronic Connectivity Project and Digital Certification Portal, and that the Ministry of Finance shall determine the means in which the fees are to be collected. The Decree shall take effect 30 days after its issuance in the Official Gazette.

Notary fees

The Vice President, Prime Minister and Ruler of Dubai, issued Cabinet Decree No. 61 of 2017 concerning public and private notary fees and the services rendered.

According to the Decree, signs detailing the fees for services provided by notary offices should be displayed, in both Arabic and English, with any amendments to fees made by the UAE Cabinet to be updated accordingly.

According to Article No. 6 of the Decree, the Ministry of Finance shall determine the means in which fees due for notary services rendered are to be collected. The Minister of Justice shall issue the necessary protocols to implement the Decree which will come into force 30 days following its publication in the Official Gazette.

Social Responsibility

Sheikh Mohammed has issued Cabinet Resolution No. 2 for 2018 regarding the Corporate Social Responsibility (CSR).

The resolution aims to place an organisational framework for national social responsibility and the mechanisms of documenting, managing and organising them, as well as placing a general framework for the incentives and privileges of practicing social responsibility and specifying the roles and responsibilities of concerned authorities, to organise and incentivise social responsibility among companies and establishments.

While executing the resolution, it was stated that practicing social responsibility is optional for companies and establishments, based on an overall desire to promote institutional giving and develop society through optional contributions to projects listed on a “Smart Platform for Social Responsibility,” which will be part of the “National Social Responsibility Fund.”

According to the resolution, the social responsibility efforts of companies and establishments will involve contributing to the economic, social and environmental development of society, through offering monetary and other contributions, adopting environmentally-friendly policies in production and work, strengthening the spirit of innovation and scientific research, offering solutions to the problems and challenges facing the community, and establishing a social responsibility culture by placing relevant sustainable strategies.
