DUBAI: A deliveryman falsely accused of attempting to sexually assault an imam’s son has won a second acquittal at the Dubai Appeals Court.

The Pakistani deliveryman, 33, allegedly tried to rape a seven-year-old son of an Egyptian imam in Al Hebab area when the Imam left the house to call for prayers on the early morning of Nov.24.2016.

The boy woke up to prepare for school. The deliveryman approached him and held him from behind. He stripped then tried to undress him. The boy resisted prompting the deliveryman to leave.

He was referred to the Criminal Court on April 6 over attempted rape. He denied the charge and argued, “I and the imam had a fight.  He vengefully filed the false complaint against me.”  The court pronounced him innocent. Prosecutors appealed on Aug.23 seeking to challenge the ruling. However, the Appeals Court has upheld his acquittal citing uncorroborated evidence. The Egyptian imam, 36, claimed he hired the deliveryman and his workmate to move furniture to his new apartment. They arrived late and worked through the night into the early hours the next day.

“I left for the mosque to call for prayers. I was in the mosque when my son came carrying Dhs3 and told me the deliveryman offered it to him. I took it normal.

“The deliveryman and his workmate finished work and left.

“In the evening I heard my son crying as he begged his mother not to beat him in case he told her something. He revealed the deliveryman groped him and tried to lower his pants, but he refused and ran away,” claimed the imam.

The imam said he asked his son to identify the man. “I contacted him and he promised to come but he failed to show up. He later contended he was busy in Abu Dhabi. He said he did nothing to my son.

“I told him what my son said. He confessed and apologised but failed to show up again. I went to the police station…He had clung to my son from behind, repeatedly kissed him, stripped before him then tried undressing him. The deliveryman’s workmate –a Pakistani driver- said, “The imam contacted calling us back to his house. There, I asked the deliveryman about the imam’s claims. He told me he only kissed the boy in a fatherly manner as he normaly treated his sons.”
