DUBAI: An ex-fugitive builder who held a complaining labourer in position as his compatriot colleague chopped his ear with a trowel was sued on Thursday.

The Asian man, 30, seized the Pakistani labourer, 27 and the violent colleague, 31, slapped him with a trowel chopping off part of his ear. This happened at a construction site in Bur Dubai around 10pm on Jan.21, 2013.

The case was referred to the Dubai Criminal Court on May 20 that year but both men declined to appear for questioning. The court jailed them in absentia for one year. The builder later showed up and requested a retrial.

During court questioning on Thursday, he admitted having had a hand in the assault but argued that the injury on the ear did not result in a permanent deformity. “It already healed.” The court set Sept.28 for the ruling.

The labourer narrated that they were on duty at the site. “I was working at the ground floor. The colleague was carrying a bucket full of cement from the upper floor. Some of the cement was falling from the bucket onto me.

“I begged him to carry the bucket with care and walk down slowly. He refused to listen to me. He went up and returned with the builder who immediately seized me. He hit my face with a trowel, injuring my right ear.”

The labourer was rushed to Rashid Hospital. A forensic report showed he sustained a 5 per cent permanent deformity. He lost one-third of the ear.
