The Abu Dhabi Family and Civil and Administrative Court cases rejected a lawsuit filed by a woman in which she demanded a man to pay her Dhs542,000 on the grounds that she lent him the amount and he did not return it, besides a 12% legal interest, the fees and expenses and the lawyer’s fees.
The woman said she knew the appellee for a long time and trusted in him, so she lent him Dhs542,000, which he asked to pay off his financial obligations, as he claimed.
She also affirmed that the appellee pledged to return the amount as early as he could but he did not, so she asked him to pay it, but he did not respond.
The appellant attached messages on the social networking app WhatsApp and her bank account statement.
The appellee denied the woman's claim and his lawyer affirmed that his client refuted the scanned images and denied his connection with them. He demanded that the appellant submits the original images, reject the case, and obligate her to pay fees and expenses and the lawyer's fees.
He also demanded tasking an information and communications technology expert to check the images and prove their authenticity.
The court indicated that the appellant provided only the copies of WhatsApp messages, which did not contain any proof of the appellant’s claim, nor did it include an acknowledgment by the appellee that he had received the amount in cash.
The court also pointed out that the statement of account submitted by the appellant indicated that she had withdrawn the amount from her account in cash, while the case papers were devoid of evidence that she had delivered the amount to the appellee, so the court rejected the case and obligate the appellant to pay the fees and expenses of the lawsuit.
