A man filed a lawsuit before the Abu Dhabi Court of First Instance, in which he stated that he had deposited Dhs3,269,000 in the account of another person by mistake, and that the latter refused to return the amount.
The appellant demanded that the defendant be obligated to return the amount, and obligate him to pay the fees and expenses of the lawsuit and the lawyer's fees.
The appellant explained that the appellee transferred parts of the amount to other accounts and withdrew another part in cash.
He added that he filed a criminal case against the appellee in which the latter was convicted by a final verdict by the Abu Dhabi Court of Cassation.
He attached to his lawsuit documents including court verdicts, the appellee's account statement, and a consultant's report.
The court affirmed that the criminal court had previously looked into the case which the civil court must abide by, and therefore the civil court must implement the verdict.
The court added that it was proved that the appellee must return the amount, explaining that it trusted the consultant's report attached to the case file, which proved that the appellee owed Dhs2,469,000 to the complainant.
The court pointed out that the case papers were devoid of evidence that the appellee had paid the amount to the complainant, and then obligated him to pay the complainant the amount, besides the fees and expenses of the lawsuit and the lawyer’s fees.
