The Abu Dhabi Court for Family and Civil and Administrative Cases obligated a company to pay Dhs532,000 to a former board member, after he filed a lawsuit against it, affirming that the company decided to distribute 10% of its annual profits to the former board members as bonuses, but it delayed giving it to him.
The complainant also demanded that the company be obligated to pay the lawsuit fees and expenses.
He explained that he was elected by the company to be a board member for eight months, and after he left the board two months later, the company’s general assembly convened and decided to distribute 10% of its profits (Dhs63 million) to the former members of the Board of Directors, including him.
The company's lawyer requested to delay considering the lawsuit pending a decision on another criminal complaint regarding the incident of squandering money.
The court indicated that the case was not connected to the report referred to by the lawyer, and clarified that the complainant submitted an advisory report proving his entitlement to the bonus.
He also attached evidence of his post as a member of the Board of Directors, and the decision of the company’s general assembly to distribute its profits for a period of one year to the members of the Board of Directors at a rate of 10%.
Consequently, the court obligated the company to pay the complainant Dhs532,000 and the lawsuit fees and expenses but rejected the complainant's claim for the legal interest.
