Al Ain court rejects electrician's plea seeking Dhs40,000 compensation from company for eye injury

Al Ain Court of First Instance rejected a lawsuit filed by an electrician who demanded to obligate his work entity to pay him Dhs40,000, claiming that he was injured in the eye while working on a project.

The Court noted that the appellant was unable to prove his claim and that the injury was actually due to his work.

The worker filed the lawsuit seeking compensation for the material and moral damages he incurred, with legal interest of 5% from the date of filing the lawsuit until full payment, besides obligating the entity to pay the fees and expenses of the lawsuit and the lawyer’s fees.

He also demanded that he be checked by a medical committee to determine the percentage of his injury.

The worker indicated that while he was working as an electrician for his employer, he suffered a serious injury to his right eye, which caused partial loss of vision, and he needed surgery so as not to lose his sight, but when he demanded compensation, he was fired.

The judge referred the case for interrogation, so that the worker submits evidence that the injury he suffered was caused by his work and that it was a result of negligence and failure to provide the necessary means of safety and security.

In the interrogation session, the worker explained that he had no witnesses to prove that.

The court indicated that he based his claim on a copy of the medical report, which was not sufficient to prove that the injury occurred as a result of work.

The court then rejected the case and obligated him to pay the fees and expenses of the case and the lawyer’s fees.
