Al Ain Court of First Instance rejected a lawsuit filed by a woman against her ex-husband, in which she demanded that he be obligated to pay her Dhs205,000, claiming that he had borrowed it from her for the purpose of investment but he refused to repay it.
The details date back to an earlier time when the woman filed a lawsuit, in which she demanded that her ex-husband be obligated to pay her Dhs205,000, besides the fees and expenses and the lawyer’s fees.
The plaintiff indicated that she owed the appellee Dhs205,000, which he received from her in cash in installments between the years 2014 and 2015, and when she asked him to return the amount, he refused.
The plaintiff's lawyer indicated that the ex-husband had borrowed the amount from her to invest in his personal business, including buying and selling sheep and poultry.
On the other side, the appellee's lawyer affirmed that the claim was malicious and asked to dismiss the case.
The court indicated that the complainant did not provide evidence that she had gave the amount to the appellee, and that her claim that he had withdrawn the amounts from her bank account was not evidence to prove that.
The court also added that the complainant did not even request that the appellee swear that he owed her the amount, and then dismissed the case and obligated the complainant to pay the fees and expenses.
