A man filed a lawsuit before the Abu Dhabi Court of First Instance, requesting that he be checked by a forensic to decide the percentage of disability he incurred due to a traffic accident. He also demanded the insurance company to pay him Dhs50,000.
The judge assigned a forensic, who indicated in his report that the complainant had permanent disability of about 5% in the right lower leg, and a 25% disability in the left lower leg.
After receiving the expert's report, the complainant demanded to raise the compensation amount to Dhs100,000.
The court indicated that the driver of the vehicle which caused the accident was insured by the appellee company, and that it was convicted, according to a final criminal verdict, and fined Dhs20,000, on charges of accidentally causing damage to the safety of the complainant's body.
The Insurance company was proved to be responsible for the incident based on the fact that the vehicle which caused it was insured with that company at the time of incident, the court explained.
Then the court ruled to compensate the complainant Dhs60,000 for the injuries he sustained, and Dhs10,000 in moral compensation, so it obligated the insurance company to pay him Dhs70,000 and interest of 3% annually, in addition to the lawsuit expenses and lawyer’s fees.
