The Abu Dhabi Court for Family, Civil and Administrative Cases rejected a lawsuit filed by a father demanding that a sports centre pay him Dhs350,000 in compensation for damages his son incurred due to an accident in which his son's nose was broken while he was skating in the centre.
The complaining father, in his capacity as the father of his minor child, filed the lawsuit, demanding that a sports centre be obligated to pay the above mentioned amount in compensation for material and moral damages his son incurred, besides the fees and expenses of the lawsuit and the lawyer’s fees.
The father said that the sports centre provided sports services, including water skiing, and that he headed to it with his son, where he had an accident and his nose broke and his face got disfigured, which also hampered his studies.
The complainant said that it all happened because of the mistake of the centre, that did not take precautions, did not follow public safety rules and did not warn that skiing is not suitable for children of his son's age.
The court indicated that the case papers did not contain any evidence of the sports centre’s fault, nor did the complainant request an investigation to prove that, nor did he file a criminal complaint against the centre when the accident occurred.
Then the court dismissed the case and obligated the complainant to pay the fees and expenses.
