The Abu Dhabi Appellate Court upheld the verdict of the Court of First Instance obligating a woman and an insurance company to pay a sales representative Dhs100,000, in compensation for the damages he incurred.
The sales representative filed a lawsuit in which he demanded that the woman and the insurance company be obligated to pay him Dhs1,284,000 and the legal interest of 12% from the date of the accident until full payment, in compensation for the physical and psychological damages incurred by him after the woman ran over him in a traffic accident due to her negligence and lack of caution.
As a result, he sustained cuts to the head and face, sporadic bruises on the body, sporadic abrasions, and a fracture in the left knee, he indicated.
The appellant indicated that the Court of First Instance fined the woman Dhs5,000 due to her negligence, lack of caution, and driving her vehicle in a manner that endangers pedestrians by not stopping when she had to.
The appellant stressed that as a result of the accident, the injury prevented him from moving freely and supporting his family, with a constant feeling of pain, in addition to his psychological suffering.
The Court of First Instance assigned a forensic doctor who proved in his report that the complainant suffered from a permanent disability of about 30% in the left lower limb, but he was able to perform his work as a sales representative who moved by vehicle, and then the court obligated the woman and the insurance company to pay the complainant Dhs100,000 for material and moral compensation and a delay interest of 4% annually from the date of the verdict.
Both the complainant and the insurance company appealed, and the plaintiff indicated that the amount was small, and in return, the insurance company demanded that the complainant be medically examined to indicate his condition and whether it was treatable or not.
The Appellate Court rejected the two appeals, upheld the ruling of the Court of First Instance, and obligated each of the two parties to pay the costs of his appeal.
