A father of a student who was beaten up by another student during a fight has filed a lawsuit before the Abu Dhabi Court for Family and Civil and Administrative Cases against the father of another student.
In his compalint he requested to oblige the father of another student to pay him Dhs51,000, in compensation for the material and moral damages incurred by his son and also pay the court fees and expenses.
The case dates back to when the defendant's son assaulted the complainant's son, causing him injuries in the left cheek and lower eye.
Surgical sutures were applied to the upper part of the wound and medical tape to the lower part of the wound.
The complainant's father indicated that the incident was a criminal case, in which the court ruled that the defendant's son be convicted of assault and damage to the reading glasses of the complainant's son.
He requested to punish him in his presence by handing him over to his guardian, provided that he undertakes to care and reform.
As for the court, it affirmed that the judgment issued in the criminal matters is authoritative in the civil case before the civil courts, and that the criminal judgment condemning the son of the defendant has become final and conclusive.
Noting that the complainant's son suffered material damage, including pain and damage to his glasses.
He filed a criminal complaint with the police who, followed up the criminal case and moral damage represented by his feeling of sadness, grief, and spreading fear.
Accordingly, the court ruled obliging the defendant to pay the complainant Dhs10,000 in compensation for the material and moral damages incurred by his son, and to oblige him to pay the court fees and expenses.
