The Ras Al Khaimah Court of First Instance fined an Arab Dhs3,000 for insulting an Asian working in a bird shop over a dispute that broke out when the defendant wanted to return a parrot he had bought from the shop and get a refund and the victim did not agree to do so.
This is the second incident of its kind between the two parties, as the Ras Al Khaimah Court of First Instance (misdemeanor) previously fined the defendant Dhs5,000 for assaulting the worker in the bird shop following the dispute that erupted between them over the sale of the parrot.
Lawyer Khadija Mukhtar explained that the incident began when the defendant bought the parrot from the bird shop for Dhs1,500 but he returned to the shop later to return the bird and get a refund.
As he refused to take the parrot back, the work and the defendant agreed that the parrot be displayed in the shop to be sold and the price to be given to the defendant, she added.
The victim told the court that the defendant kept visiting the bird shop to check if the parrot was sold but always received a negative answer.
In his last visit, the defendant pushed his vehicle’s door towards him and consequently he ran into the shop, he said.
The defendant, however, chased him and pushed him with his hands, which caused him to collide with an iron birdcage and sustain injuries.
The defendant alleged that four days after he had bought the parrot, he discovered that the parrot was sick.
Consequently, he went to the store to return the bird, but the worker refused the bird to be returned and offered to buy it back for Dhs1,200.
At this point, he asked the worker to display the bird in the shop for sale to customers and the worker agreed to do so, he said.
Later, the defendant kept visiting the shop to find that the parrot had not been sold yet and was told by the worker that the prices of birds had decreased.
As he was agitated by what the worker said, he pushed him away gently, as he described it.
