The Ministry of Human Resources and Emiratisation (MoHRE) has identified five violations that will lead establishments to be administratively suspended.
However, based on its keenness on dealing transparently and impartially with establishments that commit violations, the MoHRE enables the owners of establishments that have been administratively suspended to submit grievances in accordance with the approved mechanisms in its channels.
An establishment would be administratively suspended if it committed any of the violations stipulated in the Cabinet Resolution No. 21 for 2021 regarding the ministry’s service fees and administrative fines and its amendments, the MoHRE said, adding that the suspension would be removed after the due fines were paid.
Another violation is the establishment’s failure to provide labour accommodation in accordance with the provisions of Ministerial Resolution No. 44 for 2022 concerning occupational health and safety and labour accommodation.
An establishment would also be administratively suspended if it was accused of committing a human trafficking crime, it said, adding that the suspension would be removed if the establishment was proven innocent.
The administrative suspension would also be removed two years after the final ruling convicting the establishment of the charge.
The MoHRE indicated that the violations also include the establishment exploiting or abusing the electronic powers granted to it to enter its systems or enabling others to do so, thereby creating an imbalance in its work procedures.
"However, the administrative suspension would be removed six months after the violation was proven," it said.
It indicated that the violations include the establishment’s violation of any of the provisions of Federal Decree Law No. 33 of 2021 regarding regulating labour relations, its executive regulations, and the ministerial decisions implementing them, and the procedure for removing the moratorium varies depending on the nature of the violation committed.
Further, an establishment would be administratively suspended in case of its violation of the provisions of the Federal Decree No. 33 for 2021 concerning the Regulation of Employment Relationship and its amendments and ministerial resolutions thereof, the MoHRE said, adding that the suspension would be removed depending on the nature of the committed violation.
