The Al Ain Appellate Court ruled that an employer be obliged to pay an employee Dhs14,453 in financial dues as he worked for that employer for more than four years.
The employee had filed a labour complaint, demanding the employer to pay him a total of Dhs23,590, including Dhs7,000 for annual leave allowance, Dhs3,000 for notice period fees, Dhs4,590 as end-of-service gratuity, and Dhs9,000 in overdue salaries. The concerned authorities contacted the employer, but no response was received.
So a decision was issued, affirming that the plaintiff was entitled to Dhs1,125 for annual leave allowance and Dhs4,328 as end-of-service gratuity, while the rest of the requests were rejected.
The plaintiff appealed the decision before the Appellate Court, stating that his employer terminated his services after more than four years of employment, with a gross salary of Dhs3,000.
He also demanded the payment of three months' salary totalling Dhs9,000 and a travel ticket allowance of Dhs1,500, besides the fees and expenses of the lawsuit.
The employer’s lawyers submitted a memorandum stating that the plaintiff left the job willingly and that he had received all his salaries, arguing that he was not entitled to a travel ticket allowance.
The employer requested the dismissal of the case and asking the plaintiff to pay the fees and expenses of the lawsuit.
The court questioned both parties, and the employer acknowledged that the plaintiff had not received the salary for the last three months and the employer's lawyer insisted that the plaintiff had quit his job willingly and demanded that he pay the notice period fees.
The court offered reconciliation to both parties, and they agreed, but no reconciliation deal was submitted by either party. Consequently, the court obligated the appellee to pay the plaintiff Dhs14,453, besides the fees and expenses of the lawsuit.
