Abu Dhabi Family, Civil, and Administrative Cases Court ordered a company to pay Dhs300,000 as compensation to an employee who worked for it and fell while performing his duties, resulting in fractures in his nose and thoracic vertebrae,
He also sustained a permanent disability and permanent impairment of 60% in the right arm, 20% in the left arm, and a permanent disability and permanent impairment of 65% in his ability to walk.
In the details of the case, an employee filed a lawsuit against the company he worked for and the site supervisor responsible for him, demanding that they be jointly ordered to pay him compensation for all damages in the amount of Dhs200,000 along with a legal interest of 12% from the date of filing the lawsuit until full payment.
He also requested appointing a specialised forensic to review the case file and conduct a medical check on him to determine his injuries, their history, cause, and reason, as well as whether they caused him permanent disability and the percentage of that disability. He also asked for determining whether the injuries were caused by the negligence of the appellees or not.
The plaintiff stated that he and the second appellee worked for the first, and due to inadequate supervision and the lack of a suitable and safe work environment, he was injured. He added that the appellees were referred to court by the Public Prosecution and a criminal judgment was issued against them. He also requested to amend his claims and order the company to pay him Dhs420,000 as a comprehensive compensation, along with a legal interest of 12% from the date of filing the lawsuit until full payment.
The court explained that the expert report proved that the plaintiff suffered injuries and permanent disability in the upper and lower limbs due to the fall.
The court also stated that the attached medical reports proved that the plaintiff suffered permanent injuries and permanent disability at different percentages, in addition to the moral damages he incurred and so it estimated the compensation the plaintiff is entitled to at Dhs300,000.
