Abu Dhabi Family, Civil and Administrative Cases Court ordered a man to return Dhs42,700 to a woman and fined him Dhs10,000 in compensation after he contacted her and deceived her by asking her to update her bank accounts and then requesting her one-time password (OTP).
She later discovered that the amount had been transferred from her account to his, so she filed a lawsuit against him, demanding that he pay her Dhs42,700 and Dhs15,000 in compensation for the material and moral damages she incurred, in addition to legal fees and expenses.
The plaintiff stated that the criminal court had punished the appellee in absentia with a six-month prison sentence and deportation from the country after serving his jail term.
The court explained that it was evident from the documents that the appellee had been convicted and sentenced in absentia for the charge of fraud and misappropriation of the plaintiff's funds, with a six-month prison sentence and deportation from the country.
It was also proved that he had been notified of the ruling. Based on this, the court ordered him to pay the plaintiff Dhs42,700.
Regarding the request to pay the plaintiff Dhs15,000 in compensation for material and moral damages, the court considered that Dhs10,000 was sufficient as a comprehensive compensation for the material and moral damages she incurred.
