Al Ain Court of First Instance rejected a lawsuit filed by a person against another, demanding the repayment of a debt of Dhs35,000, and a material and moral compensation of Dhs10,000, a 12% delay interest on the amount due from the date of the judicial claim until full payment, in addition to the fees, expenses, and lawyer's fees.
The appellant indicated that he lent the appellee Dhs141,000 through bank transfers from his account to the latter's, who paid part of it and refused to pay the rest.
The plaintiff presented a copy of the bank transfers, while the appellee submitted a memorandum requesting that the decisive oath be directed to the plaintiff and that the case be referred for investigation, besides obliging him to pay the fees and expenses and appointing a financial expert.
The appellee also denied that he borrowed any amounts from the plaintiff, and that the amounts exchanged between them were for small commercial operations, and that he was not indebted to him for any amounts.
The court directed the decisive oath to the appellee through one of the audio-visual communication means, who swore that he did not borrow Dhs141,000 from the plaintiff, and that his debt was not outstanding for any amounts.
The court clarified that it was established that the plaintiff requested that the decisive oath be directed to the appellee, who actually took it and so his oath settled the dispute and confirmed that his debt was not outstanding for the amount claimed. Therefore, the court rejected the lawsuit.
