Al Ain Court of First Instance obliged a person to pay Dhs30,000 to the owner of a car whom he asked to borrow his car for two days. The owner reportedly agreed, but the man did not return it and committed a traffic accident, rendering the car unfit for use.
The owner filed a lawsuit demanding that the appellee be obliged to pay back Dhs30,000 in compensation for the damages, in addition to returning the car or its value of Dhs35,000, and bearing the fees and expenses.
The plaintiff presented a copy of the vehicle's ownership and a copy of the accident report and the judge appointed an engineering expert specialised in automotive mechanics, who stated in his report that the appellee borrowed the plaintiff's car and committed a traffic accident with it, causing severe damage to it, and made it unfit for use.
The expert also mentioned that the market value of the car before the accident was Dhs25,000, and after the accident, Dhs3,000.
The court clarified that according to the case files and the report of the appointed expert, the appellee borrowed the plaintiff's car and committed a traffic accident with it, causing severe damage to it, rendering it unfit for use.
The court then obliged the appellee to pay Dhs22,000 for the value of the vehicle and Dhs8,000 in compensation, totaling Dhs30,000 to the plaintiff.
