Al Ain Court of First Instance ordered a person to return Dhs31,000 and fined him Dhs10,000 after he obtained the amount from another person through a fraudulent method and by impersonating another person and convincing him that he could bring domestic workers for him, and so, the victim handed him over the amount. When the victim reportedly demanded the return of the amount, the suspect refused.
In the details, a person filed a lawsuit against another, requesting that he be ordered to pay Dhs31,000 along with a legal interest of 5% annually from the date of the lawsuit until full payment, and a compensation of Dhs20,000 for the damages he incurred, in addition to fees and expenses, and attorney’s fees.
The plaintiff stated that the suspect seized from him Dhs31,000 by deceiving him into believing that he could bring domestic workers for him, which made him hand over the amount.
The suspect was allegedly convicted in a criminal lawsuit.
The court clarified that the suspect did not appear in court, either in person or through a representative, to defend himself and that he failed to prove to the court that he was not indebted to the plaintiff for the amount. Therefore, the court ordered him to return the amount and pay a compensation of Dhs10,000 all the damages that befell the plaintiff.
Last month, Al Ain Court of First Instance rejected a lawsuit filed by a person against another, demanding the repayment of a debt of Dhs35,000, and a material and moral compensation of Dhs10,000, a 12% delay interest on the amount due from the date of the judicial claim until full payment, in addition to the fees, expenses, and lawyer’s fees.
The appellant indicated that he lent the appellee Dhs141,000 through bank transfers from his account to the latter’s, who paid part of it and refused to pay the rest.
The plaintiff presented a copy of the bank transfers, while the appellee submitted a memorandum requesting that the decisive oath be directed to the plaintiff and that the case be referred for investigation, besides obliging him to pay the fees and expenses and appointing a financial expert.
