The Abu Dhabi Family, Civil and Administrative Cases Court ruled that a supervisor at a butchery shop was liable for compensation to an employee who sustained a permanent injury to the right upper limb and a permanent disability estimated at 20% of the function of the right upper limb.
The incident occurred when the employee (butcher) was on duty, and that the supervisor was found to have failed to provide adequate safety measures.
The plaintiff, an employee of the butchery, initiated legal proceedings against his superior, seeking a ruling that she be compelled to remunerate the plaintiff with Dhs51,000 in damages and 12 per cent legal interest from the date of filing the lawsuit until the full amount is satisfied.
The plaintiff initiated legal proceedings on the basis that he is employed by the defendant at her butchery shop. Whilst cutting meat, his hand was cut due to the defendant's failure to provide adequate security and safety measures.
As a result, he sustained medical injuries and she was referred by the Public Prosecution to the relevant court. A criminal judgement was subsequently issued against the defendant.
The plaintiff asserts that the defendant is the supervisor and controller of shop and that her actions resulted in injuries to him, which prompted him to file this lawsuit.
The Court issued the judgment based on the injuries delineated in the medical report compiled by the designated forensic physician, which concluded that the plaintiff's injury had resulted in a permanent impairment of the right upper limb and a permanent disability estimated at 20 per cent of the function of the right upper limb.
