Al Ain Court of Civil, Commercial, and Administrative Cases ordered a man to return Dhs185,000, and fined him Dhs20,000, as compensation to another. The suspect had advertised a vehicle on a car-selling app, and when the victim contacted him, he cheated him by claiming that the vehicle was in perfect condition, free of defects, and in agency condition, and that it had no accidents.
A contract was then made, and the price was paid, but after using the vehicle, it was found to have defects, as it had previously been submerged in water, according to an expert's report.
The plaintiff filed his lawsuit, demanding that the appellee be ordered to return the vehicle's price of Dhs185,000, and pay Dhs30,272 as compensation for the expenses and material damages he incurred, in addition to the lawsuit fees and expenses.
He stated that after receiving the expert's report, he contacted the appellee to return the vehicle and its price, but he refused to do that.
The appellee allegedly submitted a memorandum requesting the dismissal of the lawsuit due to the lack of evidence that he had deceived the plaintiff, or pushed him to purchase the vehicle.
He also demanded that the plaintiff be ordered to pay the lawsuit fees and expenses.
The judge appointed a mechanical expert from the Abu Dhabi Judicial Department, who affirmed in his report that the vehicle had damages and was not in agency condition, as mentioned in the ad.
It was also stated that the vehicle had been previously used by a car rental company, and it had been submerged in water, causing mechanical failures, in addition to a minor traffic accident.
The plaintiff said that he had made some repairs to the vehicle to be able to use it, and he presented bills proving this, totaling Dhs14,550.
The court annulled the sales contract between the two parties and ordered the appellee to return Dhs185,000 to the plaintiff.
The court also ordered him to receive the vehicle after his mistake was proved, which caused the plaintiff material and moral damages so, it obliged him to pay a compensation of Dhs20,000.
