The Abu Dhabi Family, Civil and Administrative Cases Court ruled that a person must pay Dhs7,000 as compensation to a shop's salesman for insulting him in public, causing him great embarrassment and humiliation in front of his colleagues and customers.
It was said that a customer had come to the shop asking for a refund, which had been rejected by the shop management according to the refund policy.
The shop's salesman was shocked to find that the customer shouted and insulted him in public, in addition to spilling a bottle of water on the shop floor, in a gesture of humiliation.
In the details, the seller initiated legal proceedings against a buyer, requesting that the latter be held liable for damages amounting to Dhs30,000, as well as the payment of all associated fees and expenses.
The plaintiff submitted his claim on the basis that the defendant entered the store to request a refund, which was denied by the store management in accordance with the refund policy.
However, the plaintiff was taken aback when the defendant verbally abused him in public in a manner that offended his honour and dignity, and physically assaulted him by spilling a bottle of water on the store floor, causing embarrassment and humiliation to the plaintiff in front of his colleagues and customers of the store.
Consequently, the plaintiff file a complaint with the police, where the investigation ended by the referral of the defendant to the Criminal Court.
The Court delivered a final and conclusive judgement, convicting the defendant and imposing a fine of Dhs5,000. The judgement was upheld on appeal and became final after the expiration of the appeal period.
