Sheikh Sultan Bin Ahmed Bin Sultan Al Qasimi, Deputy Ruler of Sharjah and Chairman of the Judicial Council, chaired the Council's meeting on Wednesday, which was held at “Bait Al Hikmah,” the House of Wisdom.
Based on the directives of His Highness Dr Sheikh Sultan Bin Mohammed Al Qasimi, Supreme Council Member and Ruler of Sharjah, which stipulate that a debtor in financial difficulty should not be jailed, the Council decided to start implementing the directive by not issuing a decision from the execution judge to imprison the debtor unless a brief investigation conducted by the creditor proves that the debtor can pay his debt or that he has smuggled his money, hidden it, or stopped paying installments without justification.
Also, in implementation of the directives of His Highness the Ruler of Sharjah, the Judicial Council directed the Public Prosecution of Sharjah to coordinate with the concerned government authorities concerned with family and social affairs, to deal with family disputes and take the necessary measures to reconcile the parties to the dispute amicably before filing lawsuits or before referring them to the competent court.
The Council emphasised the importance of continuous coordination between the various authorities to ensure integration in the transitional phase, stressing the need to provide integrated administrative and technical support to achieve the desired targets, while continuing to follow up on the implementation of the steps of the transitional phase according to the highest standards.
The meeting was attended by Judge Dr Mohammed Obaid Al Kaabi, President of the Judiciary Department, Dr Mansour Bin Nassar, Head of the Legal Department of the Government of Sharjah, Judge Ahmed Abdullah Al Mulla, President of the Court of Cassation, Counselor Anwar Amin Al Hermoudi, Attorney General and Head of the Public Prosecution, Judge Dr Salamah Rashid Salem Tamim Al Tamimi, Head of the Judicial Inspection Department, Judge Abdul Rahman Sultan Bin Talieha, President of the Appellate Courts, Judge Dr Omar Obaid Al Ghol, President of the Primary Courts, and Sheikh Faisal Bin Ali Bin Abdullah Al Ma'ala, Secretary-General of the Judicial Council.
