Abu Dhabi Family, Civil, and Administrative cases Court has ordered a man to pay Dhs35,000 to the owner of a motorcycle who had taken his motorcycle to a repair workshop, but he found that the number plate had been transferred to another motorcycle and used on the road without his consent or the approval of the licensing authority.
In the details, the owner of the motorcycle filed a lawsuit against a person working in the repair workshop, requesting that he be ordered to compensate him for material and moral damages amounting to Dhs50,000.
He also requested the appointment of a specialised expert to examine the case, determine the type of the motorcycle's malfunctions after the appellee claimed to have repaired it, and assess the damages caused by him along with legal fees and costs.
The plaintiff stated that he took his motorcycle to a repair workshop and agreed with the appellee on the payment but he found that the appellee had transferred the number plate from his motorcycle to another and used it on the road without his consent or the approval of the licensing authority.
The appellee was reportedly stopped by a patrol and detained, and the motorcycle he was driving was deregistered by the traffic department.
The Public Prosecution referred the appellee to the court, where he was fined Dhs10,000 and ordered to pay court fees for causing financial and moral damages to the plaintiff by damaging his property.
The court stated that the appellee had caused damage to the plaintiff.
In the absence of him the court assessed the compensation owed to the plaintiff for these damages at Dhs35,000.
