WhatsApp conversation proves woman’s right of a debt of Dhs150,000

Abu Dhabi Family, Civil and Administrative Cases Court has ruled that a woman must repay the sum of Dhs150,000 to another woman, having loaned her the amount in question to assist her in settling her outstanding debts.

The repayment was to be made within a period of three months from the date of the loan. However, the defendant did not return the sum in question.

At the hearing, she did not deny receipt of the funds, but instead asserted that they were the proceeds of an investment. This assertion was corroborated by a WhatsApp conversation between the two parties.

In detail, the plaintiff filed a lawsuit against the defendant, in which she requested, firstly, that the defendant be ordered to pay her an amount of Dhs150,000, and secondly, that the court order the defendant to pay the plaintiff's legal costs.

The plaintiff also requested that the Court order the defendant pay Dhs25,000 in compensation for material and moral losses, and to pay interest on the amount from the date of the claim to the date of full payment. Furthermore, the plaintiff requests that the defendant bear the financial burden of the lawsuit's associated costs.

In support of her claim, the plaintiff stated that she had  transferred an amount of Dhs150,000 to the defendant as a debt to be repaid, with the understanding that the defendant would return the amount within three months.

The plaintiff transferred the specified sum, but the defendant did not return it. As a result, the plaintiff sustained damages and demands compensation.

This prompted the plaintiff to file the present lawsuit, attaching to it various documents, including a copy of the WhatsApp conversation, and a copy of the account statement.
